Three common scenarios
Crate sold as product
Empty wooden crates or packing cases sold commercially as products in their own right can fall under ex 4415.
Crate carrying goods
Single-use or reusable packing used exclusively to carry another product can be excluded once used for that purpose and presented with the product.
Used crate
Used and second-hand products are excluded under the updated Annex I wording.
